La juridiction gracieuse en voie de formation et la diplomatique épiscopale: le cas parisien (XIIe – début du XIIIe siècle)
최근 몇 년 동안 사문서(私文書) 운영 관련 주제가 학계의 주목을 끌며 임의재판(任意裁判), 공증인 재판 또는 교회 권위를 위임받은 종교재판 등에 관련된 주요 학회들도 등장하고 있다. 본고에서는 12세기에서 13세기 초까지 파리 대성당에 보관된 사문서(私文書) 운영에서 나타나는 변화에 주목하고자 한다. 여기에는 종교재판의 제도적 발전뿐만 아니라 주교들, 관리들, 봉건 영주들 또는 지역 교회들 간의 경쟁에 관한 다양한 쟁점들이 포함되어 있다. 이는 종교재판의 형성 과정과 그 실제적인 기능을 보다 자세히 파악할 수 있는 단서들을 제공하게 될 것이다.
비송재판(非訟裁判)의 형성 과정과 주교 공문서: 12세기 중반부터 13세기 초 파리를 중심으로
The subject of management for private deed causes extraordinary interests in recent years, major scientific meetings being devoted to voluntary jurisdiction, tabellionage or “officiallité” (delegated ecclesiastical authority). We consider here a mutation in the management of private acts observed in the Paris cathedral church through the 12th Century (until the early 13th century), which will offer clues to better discern the formation process of an institution and its actual functions, where were involved diverse issues, not only the institutional development of the “officiallité”, but also the competition between authorities: bishops, officials, feudal lords, or local churches.
